Final Competing Claim Resolution

All royalties from Australia and New Zealand royalty collection services must be distributed within a 6-year period.

As an example, royalties released in 2011 expire in June 2017.

The information below sets out key dates in relation to competing claims to ensure they are resolved by the Final Competing claim Resolution deadline of 15 June.

15 June Each year on 30 June deadline royalties expire. The final date to advise Screenrights about a resolved competing claim with deadline royalties is 15 June. Following this date the deadline royalties can no longer be allocated to either party to the competing claim.

Alternative Dispute Resolution Deadlines

Low Value Competing Claims

A low value competing claim is involved less than AU$500. This is a resolution pathway available to members when one party to the competing claim is unresponsive.

15 June The 15 June is the final date to request assistance under Screenrights’ ADR Procedure if the other party involved in your competing claim has been unresponsive and some of the royalties involved in the competing claim are subject to the deadline.

Medium Value Competing Claims

A Medium Value Competing Claim valued between AU$500 and AU$9,999. Members with Medium Value competing claims may request Internal Determination under Screenrights’ ADR Procedure for Competing Claims. Members may request internal determination at anytime. However, if the competing claim is subject to the deadline the following key dates apply.

30 April The 30 April is the final day to request Internal Determination for a competing claim that has some deadline royalties.
31 May In the circumstance where a member is notified of a medium value competing claim subject to the June deadline after 30 April a member may request expedited internal determination by 31 May.

High Value Competing Claims

A High Value Competing Claim is valued AU$10,000 or more. Members have two resolution pathways available to them, Mediation and Expert Adjudication. Members with a High Value competing claim may request assistance at anytime. However, if the competing claim is subject to the deadline the following key dates apply.

28 February The 28 February is the final day to request Expert Adjudication for a competing claim that has some deadline royalties.
31 March The 31 March is the final day to request Mediation for a competing claim that has some deadline royalties.
31 May In the circumstance where a member is notified of a high value competing claim subject to the June deadline after 30 April a member may request expedited internal determination by 31 May.

Express Resolution Deadlines

The ERP is designed to work alongside the ADR Procedure and is a Screenrights initiated process. Screenrights ensures that the review of any competing claim under the ERP is finalised prior to the above key dates for Low, Medium and High Value competing claims.
